Terms of Service

Who can use the Service

You must be at least 13 years old to create an account. If you are between 13 and the age of majority in your jurisdiction, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

Your account

You are responsible for the activity that happens under your account and for keeping your credentials confidential. Notify us promptly at pjeide@gmail.com if you suspect unauthorized access.

Acceptable use

You agree not to:

• Use the Service in violation of any applicable law.
• Reverse engineer, scrape, or build automated systems against the Service except for personal, non-commercial use.
• Attempt to interfere with, disable, or compromise the Service or any other user’s use of it.
• Upload malicious code or attempt to gain unauthorized access to accounts, systems, or data.
• Resell, sublicense, or redistribute the Service or its content without our written permission.
• Use the Service to harass, defame, or harm others.

User content

You may create custom lists, notes, or similar content within the Service (“User Content”). You retain ownership of your User Content. By submitting it you grant us a worldwide, non-exclusive, royalty-free license to host, process, display, and back up that content solely to operate and improve the Service. We do not claim ownership of your User Content.

You are responsible for the legality and accuracy of your User Content. We may remove content that we reasonably believe violates these Terms or applicable law.

Our content

All learning material, audio, software, branding, and design provided by us is owned by us or our licensors and is protected by copyright, trademark, and other laws. We grant you a limited, personal, non-transferable, non-exclusive, revocable license to use the Service for your own learning. No other rights are granted by implication.

Audio and AI-generated content

Some pronunciations are produced by automated text-to-speech systems. While we work to ensure accuracy, the Service may occasionally produce incorrect pronunciations, translations, or explanations. The Service is an aid to learning, not a substitute for a qualified language instructor or for native-speaker review of high-stakes communication.

Beta and free access

Parts of the Service may be offered free of charge or as a beta feature. Beta features are provided as-is, may change or be removed at any time, and may have additional terms presented at the time of access. We reserve the right to introduce paid plans in the future and to gate certain features behind a subscription with reasonable notice.

Privacy

Our handling of your personal data is described in our Privacy Policy, which forms part of these Terms.

Third-party services

The Service relies on third parties (e.g., Supabase, Vercel, Google, Meta, Microsoft) for infrastructure, authentication, and analytics. Their respective terms and privacy policies apply when you use those parts of the Service. We are not responsible for third-party services we do not control.

Termination

You may stop using the Service at any time and delete your account by emailing us. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. On termination, the licenses granted to you cease and we will retain or delete your data per our Privacy Policy.

Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant that the Service will be available without interruption, that data will not be lost, or that pronunciations, translations, or other content are free of errors.

Limitation of liability

To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Service. Our aggregate liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve (12) months before the event giving rise to the claim, or (b) USD 50.

Indemnity

You agree to indemnify and hold harmless the operator and our service providers from any claims, damages, or expenses (including reasonable attorneys’ fees) arising out of your User Content, your use of the Service, or your violation of these Terms or applicable law.

Changes to the Service or these Terms

We may modify the Service, including adding, changing, or removing features, at any time. We may also revise these Terms; material changes will be announced in-app or by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

Governing law and disputes

These Terms are governed by the laws of the United States and the State of Colorado, without regard to conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Colorado, and you consent to personal jurisdiction in those courts. Nothing in this section limits any non-waivable consumer-protection rights you may have under the laws of your country of residence.

Miscellaneous

• These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Service.
• If any provision is held unenforceable, the remaining provisions remain in effect.
• Our failure to enforce any provision is not a waiver of the right to do so later.
• You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
